1. Acceptance of Terms

By accessing or using Clear Couples ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the App.

2. Description of Service

Clear Couples is a relationship wellness platform designed to help individuals and couples assess, track, and improve relationship dynamics through structured feedback, rating cycles, agreements, and data-driven insights.

The App offers three primary modules:

  • Couples Module — A shared space for couples to rate, reflect, set goals, and grow together.
  • Relationship Readiness Module — An individual self-assessment and personal growth tool for people preparing for healthy relationships.
  • Retreats Module — A facilitation platform for organizations and counselors to run structured marriage or couples retreats, collect aggregate insights, and support participant growth.

The App is intended for personal and professional facilitation use only, as outlined in these Terms.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this requirement.

4. User Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity under your account.
  • You agree to notify us immediately of any unauthorized use.
  • We are not liable for losses caused by unauthorized access due to your failure to safeguard credentials.

5. User Content & Data Rights

Ownership

You retain ownership of all content you submit, including ratings, feedback, and relationship data ("User Content").

License to Us

By using the App, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Store, process, and display your content for app functionality
  • Use anonymized and aggregated data to improve the App, analytics, and features

Responsibility

You are solely responsible for your User Content and its accuracy.

6. Privacy & Data Use

  • Your relationship data is visible only to you and authorized connected users (e.g., your partner).
  • We do not sell your personal data.
  • Data is handled in accordance with our Privacy Policy.

We implement reasonable safeguards but cannot guarantee absolute security.

7. Subscriptions & Payments

  • Premium features are offered via subscription (monthly or annual).
  • Subscriptions automatically renew unless canceled prior to the next billing cycle.
  • You may cancel at any time via your billing portal.
  • Cancellations take effect at the end of the current billing period.
  • No partial refunds will be issued.

All payments are processed securely through Stripe. We do not store full payment details.

8. Acceptable Use

You agree NOT to:

  • Access or attempt to access another user's data without permission
  • Use the App for unlawful, abusive, or harmful purposes
  • Reverse engineer, disrupt, or interfere with the App
  • Use the App to harass, manipulate, or harm another person

We reserve the right to investigate and take appropriate action.

9. Account Suspension & Termination

We may suspend or terminate your account at our sole discretion if you:

  • Violate these Terms
  • Misuse the App
  • Pose risk to other users or the platform

You may also terminate your account at any time.

10. Disclaimer (No Professional Advice)

Clear Couples is a self-help and informational tool only.

It does NOT provide:

  • Therapy
  • Counseling
  • Medical or psychological advice
  • Legal advice

You acknowledge that:

  • Insights and recommendations may not be accurate, complete, or suitable
  • Relationship outcomes are your sole responsibility

If you are experiencing emotional distress, domestic issues, or a crisis, seek help from a licensed professional or emergency services.

11. Limitation of Liability

To the fullest extent permitted by law, Clear Couples shall NOT be liable for:

  • Indirect, incidental, or consequential damages
  • Emotional distress or relationship outcomes
  • Loss of data, profits, or opportunities
  • Decisions made based on app insights

Your use of the App is at your sole risk.

12. Third-Party Services

The App may rely on third-party services (including payment processors like Stripe).

We are not responsible for:

  • Third-party service performance
  • Payment processing errors
  • External service interruptions

Your use of third-party services is subject to their terms.

13. Data Accuracy & Insight Disclaimer

The App generates insights based on user-provided data.

We do NOT guarantee:

  • Accuracy
  • Completeness
  • Predictive reliability

You agree not to rely solely on the App for significant personal decisions.

14. Indemnification

You agree to indemnify and hold harmless Clear Couples from any claims, damages, or liabilities arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your interactions with other users

15. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved by binding arbitration in the State of Georgia, in accordance with the rules of the American Arbitration Association (AAA).

You agree that:

  • Arbitration will be conducted on an individual basis only
  • You waive the right to a jury trial
  • You waive the right to participate in any class or representative action

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

19. Relationship Readiness Module — Additional Terms

The Relationship Readiness Module is an individual self-assessment tool. By using this module, you additionally agree to the following:

Subscription & Billing

  • The Readiness Module is offered as an annual subscription at the published rate.
  • Your subscription will automatically renew each year unless canceled before the renewal date.
  • You may cancel at any time through your account settings. Access remains active through the end of the current billing period.
  • No refunds are issued for partial periods.

Nature of Assessments

  • All assessments, scores, and AI-generated guidance are for self-reflection and personal development only.
  • Results are not a clinical diagnosis, psychological evaluation, or professional recommendation.
  • You should not use Readiness Module results as the sole basis for major life decisions.

Data & Privacy

  • Your Readiness assessment responses and scores are private to your account and are not shared with any other user.
  • Aggregated, anonymized data may be used to improve the platform.

20. Retreats Module — Additional Terms

The Retreats Module is intended for professional facilitators, organizations, churches, and counselors who run structured couples or marriage retreats. By accessing this module, you additionally agree to the following:

Facilitator Responsibilities

  • You are solely responsible for the ethical and lawful conduct of your retreat, including obtaining appropriate participant consent.
  • You agree to use couple data only for direct retreat programming and participant support — not for marketing, research, publication, or any other purpose.
  • You will not share individual couple data, scores, or assessment responses with any third party outside your authorized facilitation team.
  • Any public references to retreat data must use only anonymized aggregate statistics. No identifying information about participants may be disclosed.
  • You will promptly honor any participant request to withdraw their data or revoke consent.

Account Security

  • You are responsible for maintaining the security of your facilitator account and preventing unauthorized access to participant data.
  • You may not share account credentials with individuals who are not part of the authorized facilitation team for a given retreat.

Payments & Pricing

  • Retreat access is offered via a one-time per-retreat fee based on the number of expected couples (Small, Medium, or Large tier).
  • Payments are non-refundable once the retreat has been activated and the invite link has been distributed to participants.
  • Clear Couples reserves the right to adjust pricing tiers at any time; existing paid retreats are unaffected.

Participant Data & Consent

  • Couples who join a retreat choose their own consent level (anonymous or full disclosure). Facilitators must respect the level of consent each couple has granted.
  • Full-disclosure data is only accessible when explicitly authorized by the couple.
  • Clear Couples is not responsible for any misuse of participant data by facilitators or their organizations.

Termination of Retreat Access

  • We reserve the right to revoke retreat access if a facilitator violates these Terms, misuses participant data, or engages in conduct detrimental to participants.
  • Upon termination, facilitator access to all participant data associated with the retreat will be permanently removed.
